Supreme Court Upholds President’s Power To Declare Emergency Rule, Suspend Elected Officials

  The Supreme Court has upheld the power of the President to declare a state of emergency in any state to prevent a breakdown of law and order or degeneration into a state of chaos or anarchy. In a split decision of six-to-one, the apex court held that the President, during a state of emergency, can suspend elected officials, but that such suspension of elected officials must be within a limited period. In the lead majority judgment, Justice Mohammed Idris held that Section 305 of the Constitution empowers the President to deploy extraordinary measures to restore normalcy where emergency rule is declared. Justice Mohammed Idris noted Section 305 was not specific on the nature of the extraordinary measures, thereby granting the President the discretion on how to go about it.   Earlier this year, my attention was drawn to a resident of Odu Ward who was facing a life-threatening medical condition and urgently needed assistance. I reached out to several gubernatorial aspirants seeking support, but regrettably, none responded except Professor Mohammed Sani Haruna. Professor Haruna of the All Progressives Congress selflessly took responsibility for all the surgery expenses, leaving only the cost of medication for us to source. By God’s grace, the surgery was successful, and the young man is now doing well. STATEHOUSE PRESS RELEASE President Bola Ahmed Tinubu has nominated General Christopher Gwabin Musa as the new Minister of Defence. In a letter to Senate President Godswill Akpabio, President Tinubu conveyed General Musa’s nomination as the successor to Alhaji Mohammed Badaru Abubakar, who resigned on Monday. General Musa, 58, on  December 25, is a distinguished soldier who served as Chief of Defence Staff from 2023 until October 2025. He won the Colin Powell Award for Soldiering in 2012. Born in Sokoto in 1967, General Musa received his primary and secondary education there before attending the College of Advanced Studies in Zaria. He graduated in 1986 and enrolled at the Nigerian Defence Academy the same year, earning a Bachelor of Science degree upon graduation in 1991.
